DeepChimp.AI is an experimental online information platform that provides AI-generated technical market summaries, market indicators, sentiment labels, and market analytics relating to cryptocurrency assets. The platform is operated from the Netherlands and is subject to Dutch law and applicable European Union legislation.

The purpose of DeepChimp.AI is to show how an AI model interprets technical market data, including candles, timeframes, and technical indicators, so users can compare, question, and verify the AI-generated output with their own independent analysis. The platform is not intended to replace your own analysis, research, judgement, or professional advice.

Throughout these Terms of Service, "DeepChimp.AI", "we", "us", and "our" refer to the operator of this platform. "You" and "user" refer to any person who accesses or uses the platform, regardless of location.

By accessing or using DeepChimp.AI you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Disclaimer, and our Privacy Policy, all of which form one agreement between you and us.

If you do not agree with any part of these Terms, you must immediately cease using the platform. Continued use of the platform after any update to these Terms constitutes acceptance of the revised Terms.

You represent that you are at least 18 years of age and legally capable of entering into a binding agreement under the laws applicable to you. If the age of majority in your jurisdiction is higher than 18, you may only use the platform once you have reached that age. The platform is not intended for use by minors. Under the Dutch Civil Code (Burgerlijk Wetboek, BW), EU consumer law, and other mandatory consumer laws that may apply to you, certain rights and protections apply to consumers; these Terms do not limit those statutory rights.

DeepChimp.AI offers experimental, AI-generated technical-analysis outputs for selected crypto-assets, including:

• AI-generated technical market summaries and market bias indicators, such as bullish, bearish, or neutral labels, for selected crypto-assets across multiple timeframes
• AI-generated signal alignment scores, sentiment labels, trend indicators, scenarios, and analytical outputs showing how the AI model interpreted the available technical data
• Market price data sourced from third-party data providers
• Informational analysis pages for individual assets that allow users to review, compare, question, and verify AI-generated technical analysis against their own research

The platform is intended as an experimental educational website about the current state of AI applied to technical market analysis. It is not designed to be a trading system, investment decision system, portfolio tool, or replacement for independent human analysis.

The platform operates as a non-personalised information service. It does not provide custody, administration, exchange, transfer, execution of orders, reception or transmission of orders, placing, portfolio management, advice on crypto-assets, brokerage, investment advice, or any other licensed financial service. DeepChimp.AI is not authorised as a crypto-asset service provider (CASP) under Regulation (EU) 2023/1114 (MiCA), nor as an investment firm, broker, portfolio manager, or financial adviser under MiFID II, the Dutch Financial Supervision Act (Wet op het financieel toezicht, Wft), or other applicable financial-services legislation.

Certain crypto-related instruments may qualify as financial instruments under MiFID II or national financial-services rules. DeepChimp.AI does not provide services in relation to financial instruments, derivatives, securities, tokenised financial products, or other regulated investment products.

At the time these Terms are published, DeepChimp.AI does not offer paid subscriptions, Pro access, paid signals, paid alerts, or any other paid services. If paid or premium features are introduced in the future, they will remain subject to these Terms unless separate terms are provided, and we will update the relevant legal documents before offering those features.

We reserve the right to modify, suspend, or discontinue any feature of the platform at any time, with or without notice.

The market indicators, bias labels, sentiment scores, scenarios, analytical outputs, and analysis texts displayed on this platform are generated automatically by artificial intelligence systems. They are intended to show how AI interprets technical market data. They are not human expert analysis, professional opinions, investment research, trading instructions, or personalised recommendations.

AI systems can produce inaccurate, incomplete, outdated, biased, or misleading outputs. DeepChimp.AI does not guarantee the accuracy, completeness, timeliness, reliability, availability, or fitness for purpose of any AI-generated content. Market conditions can change rapidly, and AI-generated outputs may become outdated shortly after generation.

Any references to trends, probabilities, sentiment, scores, forecasts, scenarios, projected price movements, historical accuracy, or backtested performance are inherently uncertain and do not guarantee future results. Past performance, model performance, or historical market data are not reliable indicators of future performance.

DeepChimp.AI labels AI-generated outputs to support transparency under applicable law, including Article 50 of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689). These labels should be read together with these Terms and our Disclaimer, and should be displayed directly with AI-generated outputs where reasonably possible.

Based on the current intended use of DeepChimp.AI as a non-personalised, experimental information service, the platform is not intended to make decisions about individuals, provide personalised financial recommendations, or replace independent technical analysis. DeepChimp.AI reviews its AI Act obligations periodically and may update its transparency measures if the platform's functionality or applicable law changes.

Subject to these Terms, DeepChimp.AI grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your own personal, non-commercial informational purposes only.

• View AI-generated market indicators and analytics for personal reference
• Use the platform to compare, question, and verify AI-generated technical analysis against your own independent research
• Share individual indicator screenshots for personal, non-commercial commentary, provided that the AI-generated and non-advisory nature of the output is not misrepresented

You must not use the platform in any way that:

• Violates any applicable Dutch, EU, or international law or regulation
• Involves scraping, crawling, or automated data extraction without our prior written consent
• Reproduces, redistributes, sells, or commercially exploits any content from the platform
• Attempts to reverse-engineer, copy, or replicate the AI models or algorithmic logic of the platform
• Misrepresents AI-generated outputs as licensed financial advice, personalised recommendations, investment research, or expert human analysis to third parties
• Uses the platform to provide regulated financial advice, portfolio management, brokerage, order routing, or other regulated services to third parties
• Interferes with or disrupts the security, integrity, or availability of the platform or its infrastructure
• Introduces malware, viruses, or any other harmful code
• Impersonates DeepChimp.AI or any of its personnel

We reserve the right to terminate or restrict access for any user who violates these prohibitions, without notice and without liability, subject to any mandatory rights that cannot lawfully be excluded.

All content on the platform — including but not limited to the DeepChimp.AI name, logo, design, layout, software, AI model outputs, text, and graphics — is the exclusive property of DeepChimp.AI or its licensors and is protected by Dutch copyright law (Auteurswet), EU Directive 2019/790 (Digital Single Market Directive), and other applicable intellectual property laws.

No content may be reproduced, distributed, modified, or used for commercial purposes without our express prior written permission. The limited licence granted under Article 6 does not transfer any intellectual property rights to you.

Third-party cryptocurrency price data remains the property of the respective data providers and is subject to their own terms and licences.

The platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by Dutch law and EU consumer legislation.

We do not warrant that:

• The platform will be uninterrupted, error-free, or free of viruses or harmful components
• AI-generated outputs, market indicators, forecasts, scenarios, or analytics are accurate, complete, current, reliable, or suitable for any particular purpose
• Third-party price data is accurate, complete, current, or delivered without delay
• Results obtained from using the platform will meet your expectations

Nothing in this Article limits or excludes any warranty, remedy, or consumer protection that cannot lawfully be excluded under Dutch consumer law, the Dutch Civil Code (Burgerlijk Wetboek), or applicable EU consumer protection legislation.

The processing of any personal data in connection with your use of the platform is governed by our Privacy Policy, which forms part of these Terms. We process personal data in accordance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and the Dutch GDPR Implementation Act (Uitvoeringswet AVG).

If you access the platform from outside the European Economic Area, other mandatory privacy or consumer-data laws may also apply depending on your location. Nothing in these Terms limits any privacy right that cannot lawfully be excluded under applicable local law.

The competent supervisory authority for data protection matters in the Netherlands is the Autoriteit Persoonsgegevens (AP). You have the right to lodge a complaint with the AP if you believe your personal data has been processed unlawfully.

The platform may contain links to third-party websites or display data sourced from third-party providers. Such links and data are provided for convenience only. DeepChimp.AI has no control over, and accepts no responsibility for, the content, privacy practices, accuracy, or availability of any third-party website or data source.

Accessing third-party websites from our platform is done at your own risk and subject to the terms and conditions of those websites. We do not endorse any third-party products or services linked from this platform.

We strive to keep the platform available at all times but do not guarantee uninterrupted access. The platform may be temporarily unavailable due to scheduled maintenance, emergency repairs, third-party data outages, or circumstances beyond our reasonable control (including force majeure events as defined under Dutch law).

We reserve the right to modify, suspend, or permanently discontinue the platform or any part of it at any time without liability, provided that where reasonably practicable we will give advance notice of planned outages.

We may update these Terms at any time to reflect changes in the law, our services, or our business practices. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, provide a notice on the platform.

Your continued use of the platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the platform. We recommend reviewing these Terms periodically.

DeepChimp.AI is operated from the Netherlands. The platform is not intended to be offered, promoted, or made available in any jurisdiction where its availability, content, functionality, or use would violate applicable local law or regulation.

You are responsible for ensuring that your access to and use of the platform is lawful in your country, state, province, territory, or other place of residence or access. If accessing or using the platform would be unlawful in your jurisdiction, you must not access or use the platform.

Unless expressly stated otherwise, DeepChimp.AI does not target, solicit, promote, or market its services to users in any specific country outside the Netherlands and the European Union. The availability of the platform in another country does not mean that DeepChimp.AI is licensed, authorised, registered, approved, or suitable for use in that country.

DeepChimp.AI is not registered, licensed, authorised, or approved as a broker-dealer, investment adviser, commodity trading adviser, financial adviser, securities adviser, crypto-asset service provider, digital asset service provider, virtual asset service provider, exchange, trading platform, or equivalent regulated entity in the United States, United Kingdom, Canada, Australia, Singapore, Switzerland, Hong Kong, or any other non-EU jurisdiction.

Nothing on the platform is intended to constitute regulated financial advice, investment advice, securities advice, commodity advice, crypto-asset advice, a financial promotion, or a solicitation, offer, invitation, or recommendation to buy, sell, hold, exchange, trade, or otherwise transact in any crypto-asset, security, commodity, derivative, or other financial instrument in any jurisdiction.

United Kingdom notice. The platform is not approved by an authorised person for the purposes of the UK financial promotion regime. The platform is not intended to invite or induce UK users to engage in cryptoasset investment activity. UK users should not treat any content on the platform as a financial promotion, investment recommendation, or invitation to buy, sell, hold, exchange, trade, or otherwise transact in cryptoassets.

United States notice. DeepChimp.AI is not registered with the U.S. Securities and Exchange Commission, the Commodity Futures Trading Commission, any state securities regulator, or any other U.S. financial regulatory authority. The platform does not provide securities advice, commodity trading advice, investment advisory services, broker-dealer services, trading execution services, or any service requiring registration with a U.S. financial regulatory authority.

Other jurisdictions. Users in Canada, Australia, Singapore, Switzerland, Hong Kong, and other jurisdictions should be aware that crypto-assets, digital assets, financial promotions, investment content, advertising, and related services may be regulated differently in their place of residence. DeepChimp.AI does not represent that the platform, its content, or its functionality is lawful, authorised, registered, licensed, approved, or suitable for use in any particular non-EU jurisdiction.

You must not access or use the platform if you are located in, ordinarily resident in, organised under the laws of, or acting on behalf of any country, territory, person, or entity subject to applicable sanctions, embargoes, trade restrictions, or export-control restrictions under Dutch, EU, UN, UK, U.S., or other applicable laws.

You must not use the platform in any way that would cause DeepChimp.AI, its operators, service providers, or users to violate any applicable sanctions, embargo, trade-control, or export-control law. We may block or restrict access where we reasonably believe this is necessary for sanctions, export-control, legal, regulatory, security, or compliance reasons.

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

If you are a consumer residing outside the Netherlands, you may also benefit from mandatory consumer protections in your country, state, province, or territory of residence, to the extent such protections cannot lawfully be excluded by contract. Where mandatory EU consumer law or other mandatory local consumer law provides you with greater protection, those protections continue to apply.

Any disputes arising from or related to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent court in Rotterdam, the Netherlands, unless mandatory consumer protection laws give you the right to bring proceedings before another competent court, including the courts of your country, state, province, or territory of residence.

Consumers may have access to applicable national, EU, or local consumer-redress mechanisms. Nothing in these Terms limits any mandatory consumer rights, remedies, or dispute-resolution options available under applicable law.
